Introduction

Acid attack is one of the grave offences against the human body which involves infliction of assault by one person who throws acid on another person. It is the most vicious form of crime in the society; the acid attack crime has taken a steep rise in past few years and as usual most of its victims are women.
As per the National Crime Record Bureau there are almost 1,483 events of acid attack were recorded from year 2014-2018. The 2017 witnessed the highest number of acid attack of 317 victims, Uttar Pardesh, Bengal and Delhi have been ranking worst 10 states consistently from 2014 in terms of acid attacks.
Our government took initiativein order to reduce the number of attacks by introducing new provisions in Indian Penal Code under section326A and 326Bong

LAWS GOVERNING ACID ATTACK

Under the 226th report of Law Commission of India has proposed that the acid attacks should be made as specific offence under the Indian Penal Code and compensation should be paid to the victim. The proposal was considered by Justice Verma Committee report in 2013.
This report majorly dealt with offences against women and recommended many amendment o the existing law dealing with such offences.

The report recognized the need of introducing the new offence to punish the acid attackers The report suggested that the provision under section 326 of IPC covered the offence of voluntarily causing grievous hurt using dangerous weapons which was the provision used to punish the acid attackers was inadequate, as the offence of acid attack is more heinous and, in many cases, gender-targeted. Hence provision under section 326A and 326 B has been made

SECTION 326A OF INDIAN PENAL CODE

The section 326A punished the person who causes grievous hurt voluntarily by use of acid. The essentials of the section are –

  • The offender should have caused permanent or partial damage or deformity to any parts of body.
  • The act of offender should have caused injury such as burns or maims or disfigure of any body part. Writ Petitions
  • The act should have caused grievous hurt to victim.
  • The cause of above-mentioned injury must be an act of throwing acid on victim.

Punishment The accused person under section 326B is punished with imprisonment for a term not less than 5 years which may extend to 7 years and shall also liable to fine under this provision.

Conclusion

Despite all the provisions been made or new provisions been added in law the number of these offences are increasing day by day. We as citizen of India has failed acid attack victims as there is constant rise in the acid attack cases in the country.
Fast Track Court is still a goal to be achieved for acid attack victims. Even movies like Chhapaak tried to draw the attention of media and government to prioritize fast track courts for acid attack victim.
just by making separate law will not stop these kinds of attacks speedy case disposal with help of fast-track court should also be taken into consideration for such heinous cases.
